I have a question....i have a ® trademark for the Term "Midnight Reign"
under the class 41 ....i use this mark across the us in print ads and online and through the distribution of merchandise and phonorecords...
Their are a few bands that have put up wensites on social networking sites
like youtube and myspace..that are causing confusion and dilluting the mark..
If contact with the offending party cannot be established..what other recourse do i have? Shouldn't the sites hosting these guys take them down
if i show them documentation?
One of the offending parties even went so far as to call me an idiot and that this is a copyright issue? Is he now knowingly violating my rights and subject to harsher statutory penalties...if i sue?
What can be done if you can't expend the resources to sue??
