Shoplifting, Larceny, Robbery, Theft Theft Question!!help Asap!!!!!

ok i just figured something out. i was charged with theft by shoplifting. but the bottle of cologne i attempted to steal was only $34.50 so why was i not charged with just petty theft. it states in georgia criminal code that 50-400 dollars is a misdemeanor and above is of course felony. below that is an infraction/violation much like a traffic ticket. the retail store i tried to steal from did not make me sign anything or claim any other costs that would make this go up. i was of course banned from the store and mall. but is it the judges choice whether or not its considered petty theft??? please help:yes: :nuts
