her name is the only one on the summons and they are asking for a reply in 20 days ( the summons is asking ) what kind of reply do they want ? it has been almost 4 years what can they do to her or us, she has no job.

you were served court papers, a summons and complaint? That would mean that you are being sued. The so called "answer" then has to be a formal answer to the complaint, which need to address the items in the complaint, even if only saying that you are not saying anything to it now, and must be formally served on plaintiff and the court according to the rules there. You might have instructions included in the summons on how to answer it. Otherwise read this here, though this is NOT FROM TEXAS, this is only an idea what this is all about: http://www.ramsey.courts.state.mn.u...ONS FOR ANSWERING A SUMMONS AND COMPLAINT.doc

So if it is something like this, you should either consult an attorney or at least the pro-se clerk at the courthouse and find out how to write and serve an answer. If you do not answer in the correct way, the plaintiff might be able to get a default judgment, and that is something you probably want to avoid.

What can they get? A judgment against you. If they can collect on it when you don't have anything is a different matter.
