My jurisdiction is: Washington

My 16 yr old son was hanging around with friends one day and that decided to steal beer. In both stores, my son was seen picking up but putting back the beers before leaving and he did so voluntarily (on video), .

Is this in fact MIP? Or is this defendable since the beers never left the store and they were never opened (according to my son and to the police reports).

I'm not 100% sure, but I think your son is screwed. I know for example in Indiana if anyone under 21 is working the cash register (grocery store, etc) they are not even allowed to scan the booze. They have to have the customer slide the beer scross the scanner for them. And from what I can find Washington state is pretty serious aout MIPs.

So just the fact that he picked it up might be enough.
