TD status

    My son and I have outstayed our TD status. My husband is working on his 3 year TN work visa.

    We have an american child.

    I want to become legal again.

    My last year of in status was 2003.

    Can I and my son just leave the USA, come back and re-apply for my TD status. We both have new Canadian passports.

    How will the border crossing people not know that we moved back to Canada and we are now ready to live in the USA again.

    What record does the INS have after 2003..as I am not allowed to work in the usa.

    Can I leave the USA tomorrow with my husband who is on a TN, and come back attached new to his TN visa.

    I need some really great help

    I believe its called an I-9 form. You filed it when you came the first time and you will file it when you leave. The two forms will show how long you were in the country. Fooling the US Government isn't so easy. If you want this to work get an attorney.
