I hope someone can provide legal advice with California civil law support..... I quitclaimed a home to ex-spouse during a divorce. He subsequently quitdeeded it to an LLC corporation. Both were filed with San Bernardino County. At time of both transfers the HOA assessment fees were all current. Unfortunately the LLC have failed to pay any assessments since. Can the HOA hold me liable for fees and penalties accrued for 3 years after I quitclaimed the property?

Does a quitclaim differ from a regular sale when determining who is legally responsible for HOA fees occuring after the transfer - the previous owners (me) who's dues were paid in full, or the LLC who failed to pay after deed transfer?

Can they file against you?
Sure.
Will they?
Who knows.
If they do, okay, your defense is the quit claim.
You gave away or sold your interest in the property.
If they go after you, assuming things were done correctly, you have an affirmative defense.
You don't own the property.
