As member of a fraternal organization that does volunteer work in community, we were recently asked by a local church to assist in a fund raiser. Our involvement required that we BBQ chicken for a plate sale to benefit the church youth group. Approx. 1,500 plates sold, unfortunately 150 people became ill. Church insurance covered claims, but now looking to our organization for subrogation. Our involvement was limited to volunteering labor to BBQ the chicken, along with assistance from members of the church. We cooked the chicken provided by church and packed in ice chests for delivery on day of benefit. Other church members and organizations contributed by preparing side dishes and other meats. Our organization however is the only legal entity. Insurance claims that food poisoning was the result of food preparation. Our organization was not involved in serving and feel that this process could have been a source of the problem. As well as preparation of other food items that were served. Where does liaiblity lie? My organizations insurance policy is limited to coverage of the property and our building.
