Stupid Mistake...future is at stake!!! Anyone pls reply

Hi to all!

I am very new herein the US. I was withmy husband in the Navy exchange topick somethings...I kinda used of having him around and i kandalost him somewhere wentlooking out for him, got tired...went out just few steps away from the exit satdown on the bench then this guy approached me... Askingme that i have items that belongsto the store which i gave him, everything went so fast that i only realized what was wrong when we we were escorted at the office and asked question, then suddenly came the police who asked questions again then lateron lets us go...no arrest, no citations and no fine that time. We were advised by the staff that a letter will be coming for me to pay the fine for the store. I was so emabarassed of what happened...by the way it happenedin the state of california

Three weeks ago came the letter for the fine of $200 which we had already paid...now i believe that sooner or later there will be a letter coming from the court for the charge.

I just have some few questions;

-Is there any possible way to control thisfrom happening? Like perhaps hiring a lawyer for him tolook into the police report or maybe settle it with the DA before the charge been made?

-What will be the possibilities of a lawyer resolving this matter? Iam trying to avoid having a convcition or any criminal record since myprofession is in the health care field and whatever record imay have in the near future willdefinitely have great effect on me.

-lastly, I am still in the process of my status herein the US that complicates it...I do wanttoplead guilty because this situation resulted to my stupid mistake..besides iknow a simple theft isalready considered moral torpitde...

Please advise,i reallydonot know where to start

as far as I understand you are an alien in the US and might be charged with larceny.

Now, since there is a lot at stake here you should consult an attorney who knows about the impact of such a charge on your immigration status.

An attorney might be helpful in dealing with both the store and the D.A.s office to find a way to dispose of this case so that it will not negatively impact your status and your criminal record.

Depending on the circumstances there might be some ways you should explore with your attorney. What you would want to do is avoid a conviction or pleading guilty to larceny, because that would seriously impact your immigration status.

Larceny occurs (as opposed to grand larceny) when the value of the amount stolen is under $1,000. Here is the relevant NY Penal Law code for the section.

New York Penal Law

Section 155.05 Larceny; defined

1. A person steals property and commits larceny when, with intent to deprive another of property or to appropriate the same to himself or to a third person, he wrongfully takes, obtains or withholds such property from an owner thereof.

2. Larceny includes a wrongful taking, obtaining or withholding of another's property, with the intent prescribed in subdivision one of this section, committed in any of the following ways:

(a) By conduct heretofore defined or known as common law larceny by trespassory taking, common law larceny by trick, embezzlement, or obtaining property by false pretenses;

(b) By acquiring lost property.

A person acquires lost property when he exercises control over property of another which he knows to have been lost or mislaid, or to have been delivered under a mistake as to the identity of the recipient or the nature or amount of the property, without taking reasonable measures to return such property to the owner;
