My husband was placed on probation for a 2nd degree felony in 1995, he violated it and a warrant was issued in 1996. He was later arrested and sent to prison on seperate charges in 1997. Before he was released in 1999 florida was contacted and they refused to extridite him. Now in 2005 he has been arrested in florida for the 1996 warrant. Is there any defense, like failure to prosecute back in 1999, or a statute of limitation? Please help?

I totally understand your dilemma. I'm not sure about any statute of limitations on this as I believe the warrant being issued back in 1996 actually authorizes the state to keep the case open. Another words, when they issue a warrant, they are saying in so many words that are seeking prosecution against you then and there as soon as they can locate you.

Perhaps you can shed some light on exactly how why they wanted to revoke his probation. A good lawyer can really help out with probation situations.
