I'm looking to start a small business. My question is about incorporating an already existing toy like Shopkins or My little pony into a new product that I'm making. Am I legally aloud to do that? Would I be able to use the name shopkins, for example, or not? Or any information you could give me in these regards would be great. Thank you.

Do I need to get a legitimate title, business title like LLC for taxes? or maybe something different?

That's called infringement and is likely to get you sued and put out of business real fast.

There's no simple answer to the type of business entity you choose. For tax purposes you can operate as a sole proprietorship doing business as..., or you can form an LLC, if you like.

Thank you for the information. I appreciate it. I guess my plan was to make soap with toys in them, and you would say it would be infringement still if I took a shopkin or a hello kitty, let's say and put them into the soap to sell.
I wondered because I have seen them out there for sale and was curious. Thanks again.

Yes.

You would be using somebody else's product as a basis for selling your own.

In other words, "Buy my soap with the Shopkin in it" as opposed to just "Buy my soap" if it didn't have a Shopkin in it.

If you want to do that you'll need to contact the manufacturers and get their permission to use their products that way. You would probably be required to pay for a license to use their products that way.
