I wrote a song named I'm On Top and in 2009 and just noticed someone else has a song with same title, i recorded the song on demo with a company, can they use the same title? Is it legal?

Change the title or you are likely to get sued.
It's that simple.
Even if you don't lose the lawsuit, it will cost you tens of thousands of dollars to defend and you don't get that money back.
