simple question Criminal Records, Expungement

    Is it legal for a state agency to ask someone if they have ever been arrested?

    Yes, why wouldn't it be legal? This may be uncovered anyways during a background check. If you were arrested but never charged or convicted with anything, you should see an attorney about an expungement.
