Set aside conviction

I have two misdemeanors in 2004 and a felony in 2004. The felony is after the two misdemeanors. I haven't even gotten as much as a traffic violation since the felony, and went to court today to get the felony set aside. I have an associates and bachelors degree and can't obtain employment in my field of study due to the felony. I was told by the prosecutor that I can hire an attorney to challenge the two misdemeanors and then have the felony expunged. The attorney general of Michigan opposed my motion to set aside the felony. At the time of my conviction, my attorney told me that I could get the femony off in 5 years granted that I turned my life around and stayed out of trouble. Can I get the misdemeanors off by hiring a lawyer to challenge them? Is there anything that I can do?

First of all, you shouldn't believe ANYONE that promises you you can get your record EXPUNGED or convictions set aside.

Yes, it can be done, but it isn't automatic.

What can you do?

Do exactly as the prosecutor instructed you to do, speak with an attorney and see IF the misdemeanors can somehow be removed.

But, the misdemeanors aren't as big a problem for you as the felony!

And, no matter what anyone says, none of this is promised to you.

You can only follow the protocol and see what happens.

I've known people that had to try four or five times, before they got their desired result.

I've also known people that have tried 10 times, to no avail.

No one knows what might happen to you.

You shouldn't assume, demand, or expect ANYTHING, but the right to try!


ALL YOU CAN DO IS KEEP TRYING.


You can also seek a pardon.

Again, you have NO right to any of these legal redresses, only the right to avail yourself of any of them!

Think of it this way, you have the RIGHT to a fair trial.

That doesn't mean or imply that you'll get acquitted, just the RIGHT to a fair, trial!

Thank you for youe advice. I know that I am not intitled to anything, I just am loking for any advice as to what steps to take next. If I get the misdemeanors removed, then I can approach the court again regarding the felony.
