My son had an MIP infraction in San Diego recently reduced to a disturbing the peace (415 1 penal code) and the fine waived (if he doesn't get a similar ticket in the next year). My question is, on the letter the San Diego court also said "415 (1) is disturbing the peace and would require a license suspension as would be with your initial charge of 25662a BP MIP." But they didn't say for how long. If we accept the reduced charge do we then hear from the DMV?
Thanks for any info you can provide.

Well that daesn't sound like much of a plea bargain.

It sounds like a defered sentence. Meaning, nothing will happen as long as he's a good boy. If he should get another ticket, the original charge would apply. That's where I'm confused. They want to reduce the charge, but keep the same sentence. That's messed up.

DMV decision separate from Court decision?

Is it possilbe that the court reduced the charge/fine, but the driving suspension is a separate issue to be decided by the DMV after we accept the plea bargain - which is why the court didn't say anything specific about it?

That could be. North Dakota does something like that. One of the guys I used to work with got a DUI. He won in court, but the DMV revoked his license anyway. Not something I understand. (The court and the DMV arre the same people, the STATE).
