Just wanted to get some opinions on a case... I recieved a CWOF and was ordered to pay 35000 however at the time of the trial the judge ordered a restitution hearing to be held to go over the case and see if the equipment i was responsible for "MISPLACING" was returned to the owner.... It was however my lawyer retired during all of this and i was pretty much on my own I went back to court and was still ordered to pay the restitution although the equipment was returned..... My question is basically how can i be responsible for restitution if everything was returned?????
Also at the trial the judge told the DA "they can't have there cake and eat it to" if the equipment is returned he shouldn't have to pay... Well i guess i caught him on a bad day when i went back with no attorney... Anyone make any suggestions on my options here
