NEED SOME ADVICE:

LIVE IN TOWN OF HEMPSTEAD, NASSAU COUNTY, NY.

APARTMENT IN 3 FAM PVT HOUSE.

NO LEASE-- MONTH TO MONTH

NOTIFIED 9/10 (LETTER DATED 9/9) OF RENT INCREASE EFFECTIVE 10/1 & WANTING MY CONSENT. LETTER LEFT IN MAILBOX HAND DELIVERED NOT VIA USPS.

IS 20 DAYS ADVANCE NOTICE CONSIDERED " SUFFICIENT NOTICE"?

IS A HAND DELIVERED LETTER LEFT IN MAILBOX LEGAL NOTIFICATION?
 
Not having a lease, even if it is month to month puts you at the mercy of the landlord. There is no legal arrangment between you and the landlord stating the terms of your occupance.

Unfortunately, the landlord has the power in this situation. If I were you, I would work this out with the landlord and sign a lease, even if it is month to month. That is the only way that you will be legally protected.
 
appealswriter38 is right in what he says, but 30 days notice tendered by the 1st of the last month under the old rent is necessary to make the notice valid. So then the rent goes up more a month later...
