Registering a child with their fathers surname

Is it illegal to register a child with their Fathers surname, without his presence? Please note...Mother and Father have never married nor have they ever lived together. His name is not on the Birth certificate.

You can call the child Smackmeinthegob Witherly Wow, if that's what you'd like.

(Though I'd imagine when little Smackme gets older he'll not be too pleased... )
