I hope someone might be able to assist. I had an elderly aunt that passed away in Feb of 2005 in NY. At the time of her death, my mother took it upon herself, as her only sibling, to organise funeral arrangements at a local cemetary. My aunt had no children and her husband passed away 20 years earlier. My mother lives in FL and paid in full 15k for a plot, headstone etc. However, it was discovered that the husband had prepaid for a plot and headstone at the same cemetary shortly before his death. After the funeral, my mother had an emergency and had to return to FL without recovering the 15k. It is now Nov 2008 and the money still has not been recovered. This was a written contract, but services were never rendered. My mother still has all the paperwork, receipts, etc.

Is there a statute of limitations for when the funds can be recovered?

Can she simply call the cemetary and try to amicably come to an agreement?

If no agreement can be made, would she have to hire an attorney to recover the funds?

Any advice would be appreciated.
