Recovering Damages after Issue is Remedied

    If I sue for a DTPA violation (illegal debt collection), and the defendant remedies the issue after I file suit, is the defendant still liable for damages? Or does the violation have to exist at the time of trial? Thank you!

    How was the debt collection illegal? In other words, what were your allegations in your complaint?

    How did the defendant remedy the issue?

    What damages?

    Depends on what the violation was, how it was remedied, how the defendant remedied the issue, and how you interacted with each other along the way.
