Is there a definitive answer regarding when I can actually terminate a lease with separation orders? Under Florida law, a servicemember who is prematurely separated from active duty with an honorable discharge may terminate a real property lease with 30 day notice.
I have received orders, but I will not be separating for a few months. Does federal or state law afford me the option to terminate my lease regardless of how much longer I will be staying in the area? I would like to give my 30 day notice instead of being locked in for another 4 months.
I'm unable to find any case law on this and the statute isn't too clear.
