Real Estate - Failure to Disclose

The builder of our home in California failed to disclose the fact that the subdivision was not connected to the city sewer system (he got permission for a temporary septic system from the city). The builder has since filed bankruptsy and ceased all construction. About 10 families that bought homes in the subdivision are affected. Can he still be sued sucessfully even though he's filed bankruptsy? Would an attorney take this case on a contingency basis?
