i have recieved a home on a quit claim deed before the person passed away. after she had passsed away i found out there was a home improvment loan on the home i was wandering if i am at all legal for the loan ? i gave the lender a copy of the death cert and they told me that i have to pay the loan or to sell the home to pay back the loan please help me if you can thank you
 
A recorded lien on property is an "encumbrance" on it. If you received a quit-claim deed from someone who has since passed away, you may indeed be legally in title to the property; but you (or more specifically the property itself) are "encumbered" by any recorded liens which pre-date that quit-claim. In basic terms, if you wished to convey (sell) the property to someone else now or at any time in the future, you would need to somehow satisfy that lienholder to do so. I'm not an attorney. Please confirm/consult with one to verify this.
