My husband and I operate a small sole proprietorship.

We recently contracted to do an energy efficiency window upgrade in a local school.

To keep this as to-the-point as possible:
Some of the material we ordered and installed is not what it's manufacturer claims it will be. The substrate is a lesser quality material that wicks water rather easily. The material that was supposed to be used for the substrate is a water resistant material. The company's website, product book, and an e-mail I received very recently all specify that the better material is the substrate they use, but they readily admit that the product I received is, in fact, made with the lesser product.

This product has failed and separated already. Some of it showed visible failing within weeks of installation.
The manufacturer refuses to remedy the situation, blaming the problem on anything & everything else.

Aren't they on the hook because they used a substandard material?
Even if we hadn't installed it 100% right (which is not the case), wouldn't the material breech trump the installation?
