I have 1 question, under the Commonwealth (English Law) If a person who was married died without a will, has a child (over 18) and the living spouse abandoned the marriage for over 10 years. How can the next of kin (which is the child) apply to be an exectur? There is no property, there is just a years salary from deceased former workplace. Please note that the living spouse cannot be found (living somewhere in the USA). According to English law, what laws/remedies is the child entitled to as the remaing living spouse cannot be located?
