My son and a friend pulled up to our house heading east at 2:00 am. Stopped and after a westbound police officer passed got out of the friends car. Walked toward the house, got to the front porch, the police officer had made a U turn and parked behind the friends car and called them over to him in the street. He told them he smelled marijuana and that was his probable cause to search the car. My son admitted having the small remains of a marijuana cigarette in the friends car he had smoked a few hours earlier, but not in the car. They soon had 4 police cars and detained them for an hour in seperate cars. Questioning about drug dealers etc. One deputy gave them a business card and told my son to call tonight. If he doesn't call they will issue a warrant for his arrest. It seems to me the first officer did not have probable cause.
