Power Of Attorney For Elderly Parent

I live in Chicago and my 70 year old father lives in Oklahoma. He currently has a host of health issues like, Dementia, Diabetes, Congestive Heart Failure, etc. and is no longer able to care for himself. He is rushed to the hospital almost every other week but refuses to give me or my sister in Oklahoma power of attorney because he doesn't want to live in a facility. We've tried having him set up with a nurse to take care of him but he won't cooperate with her which results in him not taking his medication properly. We need to have him placed in a facility before he harms himself. How can we get power of attorney without his consent so that he can get the 24-hr care he needs.

Typically it must be determined that the patient/client (your father) is incompetent to make his own decisions regarding his needs and care. If he is deemed incompetent, the court can award another person (typically a family member) power to make these decisions in his place.
