Post letter of demand to tenant

My tenant was sent a letter of demand to pay 3 mos rent by my lawyer. If he ignores this does there have to be an eviction hearing or can the lawyer have an eviction notice posted on the door giving him a certain time to vacate. The property is in New York.

The letter you allege to have been sent is simply a request for your tenant to vacate the unit VOLUNTARILY.

The tenant can ignore the letter.

Only a judge can order someone to be evicted.

So, if your tenant IGNORES the letter, YES, there will be a court hearing.

If it goes that route, expect it to take six to eight weeks, maybe more!!!
 
Yes, your lawyer can write up another letter giving the tenant a specific date to be out, however that letter can be ignored just as the previous one was. Such a letter might persuade a tenant to move along, but not if the tenant has a little bit of know-how as to how the system works.
