Can anyone tell me what exactly the charge Criminal Possession of an illegal substance in the SEVENTH degree means in New York State? And possible penalties for this charge? Also if one was held overnight on this charge in lieu of $500 bail, and released ROR based on pre-trial recommendation in the morning, wouldn't there be a written "something" other than a small slip of paper that gives the Judges name, court date and a hand written statement that says "hire a lawyer". No Miranda and a 3-day job suspension for no-show to boot. Originally stopped for V&T 68 in 65, and Agg ULicensed oper 3rd was showing on system. Arresting officer looked in veh to locate disposition showing charges cleared over month ago and states he found small quantity of Mj. Claimed he was unable to find disposition info showing clean license. And when asked to bring at least one of 2 breathing inhalers, refused. Both the disposition & receipt for fine where right on top of paperwork in glovebox when we picked up the vehicle in the morning. We are very confused and would appreciate some information on this.

Criminal Possession of a controlled substance in the seventh degree is § 220.03 of the New York Penal Code:

A person is guilty of... when he knowingly and unlawfully possesses a controlled substance.

It is an A misdemeanor.

This is the basic charge for any possession of a controlled substance, all other degrees (1-6) are more serious charges.

A class A misdemeanor carries a maximum of 1 year in jail, but usually if this is the first offense it will be disposed of with a fine or probabtion or both.
 
if a person is charged with A Misdeanor in the 7th degree-barbituates-according to what I read a person can be put on probation and/or fined if it is the first offense; otherwise, it is a year in jail. what if the person is on conditional release-parole but that offense was burlary?
