Petty Theft advice needed ---- caught at Kohls California store Shoplifting, Larceny, Robbery, Theft

    Recently caught by Kohls California store for a petty theft of $50. Officer charged with Misdemeanor. Will they put me in Jail or just some fine and community services? The merchandise is of $44 dollars. Can I appeal for Infraction? Why did they charge me Misdemeanor?

    I am feeling so embarrassed about the whole thing now since for few dollars I have lost all my peace of mind, sleep and I am not able to live my normal life. I have to appear in front of court in month of February. Has someone faced this kind of situation? Will it remain on my records?

    I really dont want to go in Jail. I am ready to pay fine. Will i be on some probation? Is there any kind of diversion program that i can request for?

    I have recently started my new job few months back and I am a Part Time Student. I have learned my Lesson already and I WILL NEVER REPEAT this MISTAKE in my whole life and never do such ACT.

    Can I just defend myself in the court. I called few Lawyers and they are charging me $5000 which is too much for me to afford. Does anyone knows any other option that I can use to defend myself in the court?

    I am scared of going to JAIL and I dont want to go to JAIL.

    Can someone please list me all the options that I can take to avoid going to JAIL and keeping off these thing on my Records.

    Please Advice and Help.

    They will probably accept a plea to the infraction, depending on the circumstances and if the value truly WAS under $50.

    Possibly and possibly.

    If you cannot afford an attorney, one will be appointed for you at arraignment. But, the DA may offer you a plea to the infraction at that time.

    Do you know if there will be any JAIL for this? I am scared to death of the fact of going to JAIL. Can i get this down to Infraction? Will it be on my record?

    Yes, it is POSSIBLE to have it made an infraction if it is a first offense and the value of the items was under $50. No one can possibly say if this will be offered or not until it happens.

    Will there be any JAIL in this case? This is my first offense and I am scared to death of going to JAIL. I have already learned my lesson and I am not able to sleep in the night and live my normal life.

    No one can say. If it is filed as an infraction, no jail time will result.

    In the citation that the officer issued me, it is marked as M. Does that means it is filed as Misdemeanor? Do i need to contact to PD before my court date? I cannot afford the fees of Attorney. Can I write a letter of apology to the Kohls Store and will they drop down my charges? Will they allow me to pay the Civil Demands and drop the charges?

    That is how the offcidr issued the citation, that is not necessarily how the DA will file it with the court.

    You can contact the Public Defender when you like, however, they usually will not talk to you until after the arraignment and the court has said you are eligible for a PD.

    Kohl's has no say on the charges. And a letter of apology may be used against you as evidence of guilt.

    It is possible that the state will drop the charges if you agree to pay the civil demand, but they don't have to as you have to pay the civil demand anyway.

    Sir, I am glad that so far you have been helping me with all the questions that I asked.

    One more thing I wanted to clarify was that on the citation that the officer issued me he has mentioned "6" in the "Beats". I am not sure what exactly he means by Beats = 6 on the citation that he has issued with Misdemeanor.

    So is it the DA who decides whether it will be filed as Infraction or Misdemeanor with the court?

    Also according to your previous reply, it seems that writing an Apology letter to Kohls is not a good idea since they can use that evidence against me?

    I will appreciate if you can clarify these things to me.
