Pet Feces Fine

So I live in an apt complex and have a medium sized dog. I recently received a letter and invoice from the property manager for $75.00 for dog feces fine.

The letter says something to the effect of:

"Our staff has observed that you failed to pick up after your dog..."

They supposedly have one groundskeeper that reports residents. Given the size and area of the complex and the fact that my dog goes once in the morning, once in the evening and once at night. 2/3 or 66% of her business is outside of business hours it is highly improbable that such employee could make an actual observation (with the exception of Quantum theory where every possible probability is true and cannot contradict each other).

On top of that, it is such fee/penalty is not described in the lease or or the pet agreement (addendum to the lease agreement).

Without substantiating the claim, can a landlord arbitrary issue such fees?

LOL Gail there ya go.. responsible pet ownership is the responsibilty of the owner and that does include picking up after your dog.
