being charged with misdemeanor theft, I confessed but have not gone to court and the victim is wanting me to give back the 100.00. can I give it back or do I have to wait for the court to tell me to.
 
My gut says give it back now and get a signed receipt or pay by check or money order so you have documentation.

You'll look better in court so you might get a lighter sentence or even a dismissal if you can convince the victim not to show up.

Or, it might not make any difference at all.

Either way, you should be talking to a lawyer about your options before you do anything.

You've already foolishly spilled the beans on yourself.
You've probably violated your release bond by talking to the victim.
I suggest you KEEP the $100 until you've spoken to a lawyer.
It's also in your best interests to stay at least 500 yards away from the victim until after the trial ends.
That means no telephone calls, no emails, no letters, no contact of any kind.
For your sake, stop talking about this, and stop trying to fix it.
Now that its in court, only a judge and jury can fix it.
Assuming, that is, that its fixable.
