Patent Applied For

A competitor of mine has recently come out with a new product that is very similar to one that we were working on. It is not exactly rocket science, its kind of a combination of 2 things that everyone has been doing for a while. As I looked at his product i noticed several minor differences in construction and material, but nothing major (ie the purpose and design are almost the same). Currently on his product he has a "patent applied for" label. I have heard that he doesn't really have one, it is just something that he wrote on the label to stop competition. I have several questions:
1. Is it legal to do that?
2. Shouldn't it be patent pending with a number so i can look it up?
3. What if anything should i do with moving forward on my product? I am ready to launch but afraid of getting sued.
4. Is there a way to search his patent?
5. Any advice going forward. Thanks,
