Hello,

After spending about 60 days in county jail, out of nowhere I was released on an OR Bond. After testimony from the "victim", I had my bond modified and was allowed to come back home. The victim gave her testimonial in court, at the Bond Modification Hearing. She stated no assault took place, so I was allowed to move back home. I was also allowed by the DA to move to the state of Florida. We struck a deal that if I stay out of trouble for a year(never was in trouble until this bogus charge), he will Nolle Prosequi my case. I have kept my end of the bargain. But that fear of the DA just wanting to put me in jail to do it is overwhelming. The fear has consumed my life giving me panic attacks and worsening depression. My question is this. Given the deal I made with the DA, the fact that I lived and still live with the victim in Florida, do you think the DA will for sure Nolle Prosequi my case? I just want this to be over with. Jail itself, was hell on earth. I can't imagine what prison is like.

No one can predict or anticipate what someone else could do.
That said, YOU know what you must do.
Keep your part of the bargain, and you can deal with HIM if he weasels or waffles.

I'm glad you've wised up about many things, especially incarceration.
Use that horrible 60 days to keep yourself on the RIGHT path.
Jail is horrible.
Prison is intolerable.
If you hated jail, prison is 10,000 times worse.

I'm glad things worked out for you.
The case will disappear, if you do as you've agreed.
I'm sure you'll be just fine.
This time next year, this won't even be a memory.

Originally, my Public (pretender) Defender was going to file a motion to dismiss. The motion stated that my rights were violated when I was indicted by a Grand Jury based on heresay evidence, when better evidence (the victims testimonial) was available. Is this true? And what are those rights and how do I find them?

If you know what is good for YOU, you'll leave this alone until your current sentence has expired.
You're out, not because you won anything, but because a deal was made.
You should keep your part of the deal, completely.
Don't worry about what the state does, until they do it.
Just keep your part of the deal.

If you want to know more about the intricacies of your case and deal, contact your lawyer.
Your lawyer should be able to tell you everything.
No one here knows anything about your case.

Write your lawyer a letter.
Ask him/her all the questions you seek answered.
He/she will eventually reply.
In the meantime, if you know what's good for you, you'll KEEP both the spirit and the letter of YOUR deal!
