Open container in BUS Alcohol & Drugs: MIP, MIC, Intoxication

    Some friends of mine recently purchased a school bus. They have renovated it completely. Our plans are to hire or get one of our friends to drive us to football/concerts events and drink along the way. Of course the drive would be mandated to stay completely sober.

    We live in the state of Indiana. My questions are as follows.

    1. Is this legal?

    2. If not, what sort of charges would the driver be charged with.

    3. Does the driver need a commercial driver’s license?

    4. Would we need to purchase a temporary alcohol permit?

    4. Could the bus be searched?

    5. If yes, could the bus driver be held responsible if a minor was on the bus that consumed alcohol.

    I don't doubt that the idea seems like fun. Most states make it unlawful to have an open container of alcohol in a motor vehicle and I would not be surprised if Indiana is no different. The liability on doing something such as you propose could be astronomical, IMHO, even if legal. I would think that this is a venture that would likely result in some type of trouble. The idea of mixing drinking and driving should tell you all you need to hear.
