I had a 40+ year old maple tree, that was cut down without my permission. How do I figure out the amount for which I can sue for? Is there a time limit, from the incident date to the time I file a suit? I want the stump removed and a new tree planted.

You will have to give us a tad more facts.

Who cut the tree down?

Where was the tree?

Who, Where, When

The tree is on my property. The person who cut down the tree, lived in my house, at that time. I have 15, or so, trees on the side of my property. The tree in question is located at the front of my property, a good 100' from the other trees. I let him know that I was looking to cut down the trees on the side. I never said I wanted him to cut any trees, only that I was going to do it some time in the future. I specifically told him, 3 times, that I did not want the tree in the front cut down. He took it upon himself to cut a few trees from the side. This resulted in a wooden fence needing repair, a light on a post needed replaced, power lines were downed, and he cut down the tree in the front. He admits he cut the tree down. He said he had to, to make room for the trees on the side to come down. Also, I drive truck, and I am away from home for weeks at a time. He did all this on his own, when I was not home. When did I arrive home, I was shocked and disappointed.
