Criminal Records, Expungement Nyclex, an expungement question.

Dear Nyclex,

I am on an F-1 Visa here. The state is Connecticut.
I was charged with larceny 6th degree, 53a-125b, the maximum penalty
being 3 months under CT law.
The charges were dismissed after participating in
deferred adjudication viz..accelerated rehabilitation / probation
for 3 months and wasn't convicted (There was no adjudication of guilt).
There was no community service or even a probation officer for that matter.

I am hoping you could guide me regarding the expungement process in CT.
I have not been able to find helpful material on the web regarding this.
You had helped me out earlier on my questions regarding the probation.
I would now like to expunge this record. Do dismissed charges automatically
get expunged.

I know you are busy and do not want to take up too much of
your time, I really appreciate this favor.

1. Do I have an FBI record related to this incident ? If so, is there something
I could do to clear it. Are there any other records which point to this incident
and is there something that can be done to expunge them as well?
2. What are the requirements for expungement, and Do I need an attorney to
go about the expungement process or can I do it myself ?
3. In the eyes of the immigration law - Was there an implied admission of guilt
although I have not admitted guilt in words or in writing. In other words does the
immigration law consider this as a conviction although the state law doesn't.
4. Am I going to be stopped/detained at the port of entry if I were to travel back home.

I am sorry, I don't know CT law. You should consult an attorney in CT with these specific questions.

Thanks for the reply. I was wondering if you could recommend an attorney in Connecticut. Someone who you think could help me. I was wondering if I needed a criminal or an immigration attorney (or) both.

I don't know any attorneys in CT. Since expungemnet usually does not work for immigration purposes you might want to consult an immigration attorney first to see if this conviction affects your status. If you want to have the conviction expunged anyway you might have to consult a criminal defense attorney. You might be able to find a law firm where they have both kinds of attorneys.

after completing the program, make sure the charges show as dismissed if they do then you have no record... that is only a 1 time chance... police is required by law to destroy or to return to you the fingerprints , mug shots or anything related to your arrest...as well as the state police has to return the records of your arrest... they won't do it on their own so make sure you contact the state police bureau of identification and make a request for them to return the arrest records to you.
