My jurisdiction is: Virginia

A few weeks ago,my mom's dementia was getting very bad and
we had to put her in a nursing home.She had been a widow for
several years living on a small pension and SS benifits.She has
a condo with about $50,000 equity in it. The nursing home admitted her
and said they would back bill medicaid knowing we had filed months
before but could not get them to commuincate with us.My mom
went downhill so fast that we failed to get a power of attorney,
so we can't sell her place. My brother had been on her bank accout
for several years so we could be sure her bills got paid. We had to borrow
money($2500) to talk to a lawyer so we could proceedings to get
guardianship and permission to handle her affairs.The lawyer said in
a meeting today, that when medicaid kicked in all of her assets would
be frozen and they would take all of her income except $40.00 a month.
He said that we could not make any more house payments or condo
fees on the condo. Also we could not pay utilities or outstanding debts she
may have. This will turn into a terrible mess. She has less than $2500.00
in savings and checking combined.The lawyer said this was state law.
Can this really be true? Her condo could be foreclosed, the power
and utilities off.
