No will and left uncopyrighted music

My brother died and left a lot of songs he wrote. We're both amateur musicians. He had no will. His wife of 2 years survives him.

I am in possession of all the music my brother wrote. Some of it is only on paper. Some were recorded by himself but not published. He had no recording contract or anything like that.

None of the music is copyrighted. The songs are all in my possession. Do they belong to his surviving wife or to me? Can I make a claim on them? Can I copyright them: either in my name or in his, even though he is dead?

Any help would be appreciated.
