I have a 7 year old condo in San Jose CA. My tenent of three years renewed the lease on June 1, 2003 for another year. yesterday I received a phone message and an email from my tenent informed me that she is moving out on Oct 31, 2003. She claimed that she had requested me to replace the carpet upstairs, repaint the condo, and lower the rent and I ignored her request. so the condo is not suitable for living. in reality she find another condo in the building for a lower rent. and she want to use the security deposite to pay for the last month of rent. what right do I have? Is it worth to hire a lawyer to start the legal action?? thanks for any advice.
