K Visa My Columbian boyfriend tried to marry and was denied, now we want to get married.

Facts about my boyfriend:
1. Entered country on 3 month visitor visa 4 years ago
2. Married american woman 30 years his senior and was denied
3. Remained in US and hasn't gotten divorced from the above woman yet

We want to get married but we want to know what the best process would be to avoid his deportation. He is basically here illegally right now, hasn't renewed visa or anything. We are very much in love but have to clean up this mess in order to start our married life together.

There is a law passed in 1998 that says that he can not get his green card for 10 years. You can marry him but he will be illegal. He forfeited his ability to apply for a green card by overstaying his visa. Every so often amnesty is offered to illegals, you could wait for that. Otherwise he has to go back to Columbia and start over again. Get an attorney to see if there is any wiggle room, but I don't think so.
