Last year we hired a landscape company to design and install our back yard. Part of the contract was a guarantee to replace any plants that died within a year of planting.
The company completed the installation and we paid in full.

Some months later, it became clear that there was a serious drainage problem in the yard. The company proposed a "fix" and completed said fix. The fix did not solve the drainage problem. We have not paid for the fix.

Now the landscaping company is refusing to replace the plants from our first agreement because we haven't paid for the drainage work from the second agreement.

Is this legal?

A: Sounds legal to me.
