My home was broken into burglerized and vandalized on 1/1/08. I called the property manager so she could come to the scene and talk to the police. I told her then that we would not be living in the apartment anymore. She told me a few days later that we could not break our lease. I told her that we did not feel the apartment was safe and that under california rental law we could break our lease. She finally got back with me this week and said that they would allow us to break it. We did not pay our rent on 1/1/08 and have not been living in the apartment. She is now saying we owe the rent for the part of January that we had "possession" of the property. Are we responsible for the rent even though we were not living there?
 
What CA law allows you to BREAK you lease for something that your landlord has no control over? Pay the money and get a "release"....your landlord is being over generous to you - take PM up on offer.
