Sure. The question is if you have a pre-emptive ground for dismissal. You are probably looking at a summary judgment motion. If the facts viewed in favor of the Respondent (them) present no questions of fact to be resolved, you can get a summary judgment. Most of the time people who want a motion to dismiss can't get one because the other party has a right to a trial if there are issues to be resolved.
