Consumer Law, Warranties mislead contract and got fried

I signed a contract with a gym on 5/23 for the two main things that I was led to believe they were a 24-7 facility and that they had tanning. I came to find out that they were not a 24-7 place but only 24hrs 4 days a week! I feel swindled! Then I found out that I could only cancel the contract within 3 days which isn't long enough to know! I signed on a Mon they close on Fri. On top of that because of their very inattentive receptionist I ended up getting burnt to a crisp in the tanning bed when she never asked me how long I wanted to tan and automatically turned it on for the whole amount of time. What can I do!? Several other people have felt as trapped and mislead as I have from this place!
 
I doubt you would have a case as far as the hours go. You have to remember that you have to prove that they told you otherwise. The fact that the hours are posted on the front door is damning to your case.

You might have some recourse on the tanning part, but ultimately it amounts to a sunburn. You would have to talk to a lawyer about that part. I don't think you would be able to get anywhere in court easily or cheaply, however it might be your leverage point to get out of the contract. Contact the manager and tell them you want the contract ended, otherwise you will pursue legal action for your injuries from tanning. Talk it up big time. You are going through pain and suffering, etc, etc, etc. They may be happy to end the contract to make you go away.
 
Thanks that is what I am doing! I got so legal advice on another website too that told me that if I was under assumption that I was getting a 24-7 place that they are under some sorta breach I guess! The thing is I saw the hours online but when I went in to sign up I was asking about the hours and they said that they were 24hrs and then I told them I heard you weren't and they said that they were so that is why I thought they were 24-7... So I got a no go on the contract cancellation right now but I have heard of a lot of people now who have had the same bad experiences there so I threatened with the misguided info, the bodily injury, and the violation of other's rights also.... Its so sad... I have never been treated like this and to be honest I hate doing this!
