I was arrested for a misdemeanor ( 3d degree theft of property) and I returned to work , at the day I returned to work my employer placed me on suspension until they conducted their own investigation . Can I be fired ? I have an upcoming court date .

Did the alleged theft involve your current employer?

If the theft was from your current employer, you most likely will be terminated (fired) but, of course, can't say for sure. Whether it was your current employer or from somewhere else, you can be terminated (fired) & it would be legal. Employer's decision whether to fire you.
