I recieved the charges of:

MIP

and

Open Intoxicated drink.

I was handcuffed and breathalyzed, and taken to jail (Blew a .088). At no point was I read my rights. Does this count for anything?

Also, when I was caught, I had orange juice with me, and nothing else in it. The officer did not check for alcohol in the cup.

no rights read

I was told, they dont have to read you your rights. Only if they are questioning you, they need to be read. I am in Idaho, maybe different where you are.

I wasn't read my rights untill they actually took me in to the booking room and decided to ask me a few questions. If they didn't sit u down and "officially" question you im guessing you didn't have to be read your rights.

Here's an update of my situation:

I got the Open Intox dropped because the way the officer wrote the police report pretty muched proved that he didn't have the right to check my cup.

As for the MIP, it cost me about $400 including the fines, the one session class, and probation for 3 months.

It's also dropped from my record.
