Alcohol & Drugs: MIP, MIC, Intoxication MIP in NM

My son got an MIP this weekend in the house he lived in. His roomate threw a party, he was not drinking and was in the process of throwing people out when the police showed up and issued citations to all of the people who lived in the house. My son was not given any kind of test to determine if he was drinking and he denied it to the police. What should we do when we go to court, he has no record and we want to keep it that way.

I will say that he doesn't have to consume to be charged.


In most states he only has to be in the presence of alcohol.

Plead not guilty and hire (or ask the court to appoint) a lawyer.

Then say nothing on this (or about this) to anyone but his lawyer!
 
If he was at home, the offense may not be so much that he possessed it, but that it was being distributed to others.
