Ok I have read many threads but still don't know what to do - so hopefully someone will answer this for me : here it goes-
i'm 19, i was pulled over late one night for "not stopping all the way @ a stopsign" they (him and his partner) smelled alcohol & searched the car (illegal right?!) he found 4 bottles of alcohol (2 empty, 2 full) inside bags.
we had to get out of the car, i had 2 friends in the car with me (16 and 18) there were no sobriety tests, we only had to breathe on one of the officers hands. I was written a ticket (which he didn't really explain) and we were brought to the station for breathalyzer. I blew a .18 (for the record, i had to do it twice because the cop said i didn't seem that drunk) and my friends blew a .05 and .10
he let me off really easy with just possession of alcohol instead of a OUI-
my questions: can i use that in court that they weren't allowed to search my car? & also won't my paper be shown in court that i blew a .18 while driving....?? so will i be given a OUI there?? i'm lost!!!! please help- court date is july 13th
