Alcohol & Drugs: MIP, MIC, Intoxication minor in possession

MY who lives with me had a 20th birthday party, I was there where they had beer but I was called into work. The neighbors called the cops and they came and charged my son with minor in possession and consumption of alcohol. This was in Indiana,is my son likely to be convicted? What statute is it?
 
I cannot tell you the likelihood of conviction, but it is significantly higher when he is a resident of the home which is having a party that includes alcohol which he is consuming. For first time offenders the penalties are likely to be reduced, possibly probation.

From the Indiana Criminal Code, I found:

7.1-5-7-7. Possession of alcohol by minor. It is a class C misdemeanor for a minor to knowingly:
  • Possess an alcoholic beverage;
  • Consume it; or
  • Transport it on a public highway when not accompanied by at least one of his parents or guardians
