Alcohol & Drugs: MIP, MIC, Intoxication MIC in Texas

I am 19, I was at a party drinking, and I walked outside to find two cops there talking to two 21 year olds. One cop immediately told me to come closer and give him my ID, which I did. He asked me how much I was drinking, I said "zero." He then asked me to blow in his face, to which I responded "No, sir." He then told me he was going to write me a ticket because he said he could smell the alcohol on me. I was standing probably 5 feet away from him when he said all of this.

I was not holding a drink and there were no containers around me. They were there for a noise complaint.

That does not sound like a very solid case to me and I'm wondering if I should fight it and what the best way to go about doing so is.

I also got an MIP over a year ago and had it dismissed via Differred Disposition

Any help is much appreciated
 
Sounds like you didn't learn your lesson two years ago. Stop drinking.
